These terms of sale are concluded on the one hand by the company Véritable SAS hereinafter referred to as "Véritable SAS" and on the other hand, by any natural or legal person wishing to make a purchase via the website of Véritable SAS called here -after "the buyer" or "the customer".

1/ Object

These terms of sale are intended to define the contractual relationship between Véritable SAS and the buyer and the conditions applicable to any purchase made through the commercial site of Véritable SAS, the buyer is professional or consumer. The acquisition of a good or a service through the present site implies an acceptance without reserve by the purchaser of the present conditions of sale.

These conditions of sale will prevail over all other general or special conditions not expressly approved by Véritable SAS. Véritable SAS reserves the right to modify its sales conditions at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer. 3/ Orders

Orders can be sent to Véritable SAS via the Internet (online shop).
The buyer who wishes to buy a product on the online shop must:

5/ Customs duties and taxes

All orders placed on the Site of Véritable SAS to a country outside the European Union may be subject to taxes and customs duties that are imposed in the country of destination.
These customs duties and any taxes related to the delivery of an item are the responsibility of the Customer and are his responsibility. Véritable SAS is not required to verify and inform its Customers of customs duties and applicable taxes. It is up to the Client himself to inquire with the competent authorities of his country. The refusal of payment by the customer of customs fees leads to the cancellation of the order and its refund. 7/ Terms of delivery

Deliveries are made to the address indicated in the order form which can only be in the agreed geographical area. Véritable SAS can not be held responsible for any errors in the customer's entry and the consequences that result (eg errors or delays in delivery). In this context, the costs incurred for the return of the order would be borne by the customer. In case of visible deterioration of the package, the customer has the opportunity to refuse delivery. In case of damage during transport, the reasoned protest must be made to the carrier AND Véritable SAS within three days from delivery. In case of dispute, the investigation may last up to twenty-one (21) working days. All claims relating to a defect in the delivered goods, an inaccuracy in the quantities or their erroneous reference must be transmitted to Véritable SAS within 48 hours upon receipt of the package, failing which the right to claim will cease. to be acquired.

8/ Risk transfer

Delivery is deemed to have been made by the provision by the carrier of the goods
ordered from the customer. It is materialized by the signature of the delivery slip by the customer.
The products ordered travel at the risk and peril of the sender; it therefore belongs in case of damage to the customer to make all necessary observations with the carrier during delivery, and at the same time to inform the customer service of Véritable.

9/ Delivery time

Orders are considered validated upon receipt of payment. Packages are generally dispatched within 24 to 48 hours (working days) of receipt of payment (unless otherwise stated at the time of order). In addition to this shipping time, Colissimo delivery times vary according to the country of destination.

In the event of delivery outside France, Véritable® SAS cannot be held responsible for any blocking by customs in the destination country. No compensation can be claimed from the sender in the event of seizure or blocking.

10/ Delivery time of pre-orders

We offer you the opportunity to buy pre-order some items currently out of stock.

A pre-order is taken into account only once paid in full, during the payment of your order. A wait of a few weeks may be expected for the product to be available and sent to you. In all cases, we strive to provide as much information as possible on the dates of availability. Delivery times for pre-orders are only indicative.

If your order contains a pre-ordered item as well as items already available, you will receive the whole once the pre-ordered item available. We recommend that you order the items in stock separately.

11/ Delivery costs

Delivery charges are based on the total weight of the package to be delivered, the mode of transport and the country of delivery. This amount will be calculated automatically before your order is confirmed, once you have entered your delivery address.

We recommend that you group all your items in a single order. We cannot group two orders placed separately, and shipping charges will apply to each of them.

12/ Right of withdrawal and return

In accordance with Articles L121-21 et seq. Of the Consumer Code, the customer has a withdrawal period of fourteen (14) clear days from the date of receipt of his order.
The customer must, prior to any return of the product, contact Véritable SAS by email in order to learn about the return procedure and at the same time make a return request on the Véritable® e-commerce site. The exercise of the right of withdrawal can only be done in writing.
The burden of proof of the exercise of the right of withdrawal weighs on the Customer, it will therefore be necessary to verify the acknowledgment of receipt from the company Véritable®.
Return costs are the responsibility of the customer except in the event of an anomaly noted on the product received, not resulting from poor transport conditions.
In the event that the customer would be led to refuse delivery of his package, the shipping costs cannot be reimbursed.
Any refund to the customer will be made within thirty (30) days of exercising this right.
Within this period, the customer will have the choice of requesting either the reimbursement of the sums paid or the exchange of the product.
When the right of withdrawal is exercised for one (or more) good(s), Véritable® is required to reimburse the Customer for all sums paid, including the initial delivery costs, without undue delay and at the latest within fourteen (14) days from the date on which Véritable® is informed of the Customer's decision to withdraw. Véritable® may defer reimbursement until recovery of the goods or until the Customer has provided a proof of shipment of these goods. The refund will be made by Véritable® using the same means of payment as that used by the Customer for the initial transaction.
This right of return can only be accepted for products in their original condition and complete (packaging, accessories, instructions, etc.), without any trace of use. Products returned and incomplete, damaged, damaged or soiled by the customer will not be reimbursed in full.

Limits to the right to reimbursement:

The Customer may be held liable by Véritable® in the event of:
  • Deterioration of goods resulting from handling other than those necessary to establish the nature, characteristics and proper functioning of these goods
  • Any damage caused to the product upon receipt of the goods by the Customer and until their return to Véritable®
  • Incomplete return of the goods and their accessories without their packaging, instructions for use, and documentation.
In such cases, the amount that may be withheld from the refund of the product or requested from the Customer may amount to:
  • 100% of the price of the good for a damaged or used product
  • 50% of the price of the good in the absence of return of accessories or consumables,
  • 10% of the price of the good in the absence of return of its instructions or documentation.

    13/ Warranty

    Garden warranty

    Véritable® grants the Customer a free national guarantee which takes effect on the date of delivery.
    The product is guaranteed if it is accompanied by its purchase invoice.
    The Customer has a period of two years from the delivery of the goods to act as a legal guarantee of conformity, subject to the cost conditions provided for by Article L. 217-9 of the Consumer Code.
    The warranty includes the replacement of parts and labor.
    "When the buyer asks the seller, during the course of the guarantee which was granted to him during the acquisition or the repair of a vegetable garden, a restoration covered by the guarantee, any period of immobilization comes'' add to the duration of the guarantee which remained to run.     Warranty exclusions

    Warranty exclusions related to the origin of the damage:
    The Véritable® guarantee does not apply in the event of accidental material damage, it does not cover in particular deterioration and breakdowns resulting from:
    • Improper installation or improper use or maintenance of the product, including:
    • Inappropriate use of the equipment or not following the instructions in the user manual;
    • Use of energy not in accordance with the manufacturer's instructions
    • Addition of fertilizer, soil or other products not recommended by Véritable ®
    • Addition of parts that do not comply with those recommended by the manufacturer;
    • Opening and modification of the content of the guaranteed product;
    • Lightning, flood, fire, overvoltage, shock, poor ventilation, fall, discoloration due to the action of light, burning, humidity, excessive heating or the presence of insects or diseases;
    • Repairs carried out and / or any intervention on the equipment and / or opening thereof by a person other than Véritable® customer service
    • Maintenance, repair or replacement of parts due to normal wear and tear or lack of maintenance
    • Corrosion, oxidation, a bad connection or an external power supply problem. If, for example, a connection is made to a defective outlet, the warranty will not apply.
    • If the device or the Lingots® are stored in an inappropriate space (damp room, too hot room, outdoor storage, etc.).

    Warranty exclusions related to the nature of the damage (indirect damage):The Véritable® warranty only covers the right to repair or replacement of the guaranteed product. Consequently, indirect damage resulting from failure or deterioration is not covered by the warranty.

    Other exclusions:
    • Damage and breakdowns falling under the specific exclusions provided for in the user manual
    • Guaranteed products that the Customer is unable to return or those returned without their accessories;
    Lingots® Warranty

    It is impossible for us to guarantee you a germination in 100% of the holes because it is about living products.
    Several external factors can influence the rate of germination and once the seeds germinate, only the most vigorous plants develop. It is the same thing in nature or when you garden outside.
    We plant more seeds than necessary in each Lingot® in order to obtain a good proportion of plants that reach maturity. A Lingot® is considered complete when half or more of the holes have germinated. Don't worry though: the plants will grow and fill the empty space.

    To benefit from our Germination Guarantee
    • Keep the batch number of your Lingot® (you can write it on the back of the dedicated label to be cut on the packaging).
    • Send us a photo of your vegetable garden within 30 days following the date of plantation.

    The Lingot® guarantee is valid for 1 year for any purchase of a Véritable Lingot® on the website www.veritable-potager.com or from one of our authorized retailers (date of invoice being proof).

    If your Lingot® is eligible with the Guarantee Germination, we refund you in the form of a credit note of the value of your Lingot® (excluded carriage costs) to be used within 1 year on www.veritable-potager.com

    14/ Responsibility

    The seller, in the process of selling online, is bound only by an obligation of means; it can not be held responsible for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, break of the service, or other involuntary problems.

    15/ Personal data

    In accordance with the law relating to computers, files and freedoms of January 6, 1978, the information of a personal nature relating to buyers may be subject to automated processing. Veritable SAS reserves the right to collect information about buyers including using cookies. Users have the right to access and correct data concerning them.

    The automated processing of information, including the management of e-mail addresses of users of the site has been declared to the CNIL registered under number 1922953.

    16/ Archiving

    Véritable SAS will archive purchase orders and invoices on a reliable and durable as a true copy in accordance with the provisions of Article 1348 of the Civil Code. The records of Véritable SAS will be considered by the parties as proof of communications, orders, payments and transactions between the parties.

    17/ Dispute Resolution

    The present conditions of sale on line are subjected to the French law. In case of dispute, jurisdiction is assigned to the competent courts of Paris, notwithstanding plurality of defendants or warranty claim.
